The Liberal Air Services Agreement ends almost six years of legal uncertainty, which began when the European Court of Justice ruled in November 2002 that bilateral civil aviation services agreements between EU member states and third countries discriminated against airlines from other EU Member States. A question was asked by UPSC in 2017 regarding the development of airports in India under the PPP model. This shows the importance of the aviation sector from the PERSPECTIVE of the UPSC. The horizontal air services agreement, signed on 25 June 2020, allows any European airline to travel to the Republic of Korea from each of the 22 member states that have a bilateral air transport agreement with the country.
Since these bilateral air services agreements traditionally provide that only airlines owned by or controlled by a Member State or its nationals can fly between that Member State and a third country, the conclusion of the horizontal agreement is therefore beneficial for airlines on both sides. The pioneering civil aviation pact would function as an “open skies” agreement and encourage more airlines to offer services between continents. India has already signed open skies agreements with Greece, Jamaica, Guyana, the Czech Republic, Finland, Spain and Sri Lanka. At the network level: the potential of the air transport sector and the handling of various related issues, the entry into force of the horizontal agreement is an important step in the EU`s air transport relations with India, a dynamic air transport market that offers considerable growth potential in the years to come. In the European Commission`s 2015 aeronautical strategy, India has been identified as an important aviation partner, with which the EU should continue to develop its links, mainly through the opening of a new dialogue. The Bilateral Civil Aviation Safety Agreement (BASA), signed on 22 June 2020, will further strengthen the EU`s already strong cooperation with Japan and strengthen the competitiveness of the aviation industry, which is crucial for the recovery of the crisis caused by Covid-19. BASA`s objective is to ease trade in aircraft and related products by supporting European producers in order to increase their market share in the Japanese market. In particular, it will eliminate unnecessary dual approvals for aviation product evaluation and testing activities, reduce the time it takes for manufacturers of aeronautical products to obtain export approvals to Japan, while ensuring a higher degree of legal certainty.
